About these terms

These terms apply whenever you use our website or buy from us. By placing an order, you agree to them.

Harmony Modern is operated by The Apollo Collaborative, ABN 38891450248, based in Queensland, Australia. "We", "us" and "our" mean Harmony Modern; "you" means the person using our website or placing an order.

Our Returns & Refund Policy and Privacy Policy form part of these terms.

Placing an order

You must be at least the age of majority where you live to place an order, or have a parent or guardian's permission.

Please give us accurate, current and complete details when you order, including your email, billing and delivery details.

Our artwork

Every artwork is printed, stretched and finished to order after you buy it. Our printing partners produce and ship it on our behalf.

• Colour: Screens display colour differently, so the printed artwork may vary slightly from what you see online.
• Mockups: Room photos are illustrations to show scale and style. Furniture and props aren't included unless the listing says so.
• Size: Sizes in inches are accurate; sizes in centimetres are approximations only. Refer to sizes in inches for accurate sizes.
• Availability: We may change or stop selling any artwork, size or finish at any time.

Orders, prices and payment

All prices include postage. Prices are in US dollars and include applicable taxes, unless shown otherwise at checkout.

• Your order: Your order is accepted when we send you an order confirmation email. We may decline or cancel an order, for example if an item is unavailable or a price was shown in error, and we'll refund you in full if we do.
• Payment: Payment is taken in full when you order, through our secure payment provider. We never see or store your full card details.
• International orders: Any taxes charged at checkout are shown before you pay. Where local import duties or taxes apply that we don't collect at checkout, you're responsible for paying them.
• Currency: If you pay in another currency, your bank or card provider may apply its own exchange rate or fees.

Promotions and errors

Prices and promotions can change, but the price you pay is the one shown when you place your order. Promotions may have their own terms, which apply alongside these terms.

If we find an error in a price, description or availability after you've ordered, we'll contact you. You can then choose to go ahead at the correct price or cancel for a full refund.

Our artwork is sold for display in your home or business, not for resale.

Shipping and delivery

We aim to ship your artwork within 7 business days of your order. You'll receive a tracking link by email once it ships.

• Delivery times: Estimated delivery times are shown at checkout. They're estimates, not guarantees, but if we can't ship within the time we've told you, we'll let you know and you can cancel for a full refund.
• Address: Please check your delivery address carefully. If a parcel is returned because the address was wrong or incomplete, we can reship it, but a reshipping fee may apply.
• Risk: The artwork is our responsibility until it's delivered to you.
• Lost or damaged parcels: If your parcel is lost or arrives damaged, see our Returns & Refund Policy.

Cancellations, returns and refunds

You can cancel your order within 24 hours of placing it for a full refund. Because every artwork is made to order, we don't accept change-of-mind returns.

Damaged or faulty items are replaced free of charge. Full details are in our Returns & Refund Policy.

Intellectual property

Buying an artwork gives you the physical print, not the copyright. Copyright in all artwork, images and text on our website belongs to us or to the artists and licensors we work with.

You may display the artwork you buy in your home or business. You may not copy, scan, reproduce, resell as prints, or use the artwork or our images for any commercial purpose without our written permission.

You're welcome to share photos of your artwork on social media. We'd love it if you tagged us.

Harmony Modern's name, logo and branding are our trademarks, and you can't use them without our written permission. Shopify's name and logo belong to Shopify.

Using our website

Please use our website lawfully and fairly. You must not:

• use it for fraud, or to place orders you don't intend to pay for
• copy or scrape our content, images or product listings
• interfere with the website's security or operation, or try to access it in unauthorised ways
• post reviews or comments that are false, offensive or infringe someone else's rights

Our store runs on Shopify, and payments, printing and delivery are handled by trusted third-party providers. Their own terms may apply to the services they provide. We aren't responsible for the content of websites we link to.

Reviews and feedback

If you send us a review, photo, comment or suggestion, you give us a free, worldwide, ongoing licence to use, edit and publish it, including in our marketing. You confirm it's your own, is honest, and doesn't infringe anyone's rights. If you received anything in return for a review, such as a discount, you must say so. We may remove content that's unlawful, offensive or breaches these terms.

Automated tools and AI agents

You must not use bots, scrapers or other automated tools to copy or collect content from our website. If you use an AI agent or other software to browse or shop for you, it must identify itself as an agent, respond honestly if asked whether it's a person, and not get around measures such as CAPTCHAs. You're responsible for any orders it places, and we may limit or block agent access.

Our relationship with Shopify

Harmony Modern is powered by Shopify, but your purchases are made directly with Harmony Modern. Shopify isn't responsible for any aspect of sales between you and us, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from claims arising from those purchases.

Suspension and termination

If you seriously or repeatedly breach these terms, we may refuse future orders or restrict your access to our website. You'll still need to pay for anything you've ordered, and we'll still fulfil or refund orders already accepted.

Liability and your consumer rights

Wherever you live, you keep the protections of your local consumer laws, and nothing in these terms limits rights that can't be excluded by contract. These include the consumer guarantees under the Australian Consumer Law, the legal guarantee of conformity in the EU and UK, and implied warranties under US state and Canadian provincial law.

If your artwork arrives damaged, is faulty, or isn't as described, you're entitled to a remedy such as a replacement, repair or refund, depending on the law where you live. Our [Returns & Refund Policy] explains how we handle this.

Our printing partner makes and ships each order from the production facility that serves your region. Wherever your artwork is made, your purchase is with Harmony Modern, and your rights are the same.

To the extent the law allows, we aren't liable for indirect or consequential loss, or for delays caused by events outside our reasonable control, such as carrier disruptions or natural disasters. Where the law allows us to limit our liability, it is limited to replacing the artwork or refunding what you paid for it.

Indemnity

If you misuse our website, infringe someone else's rights, or knowingly break the law in using our website, you're responsible for reasonable losses and costs we or Shopify incur from third-party claims as a result. This doesn't apply to the extent the loss was caused by us.

Privacy, governing law and changes

• Privacy: We collect and use your personal information only as described in our Privacy Policy. Because our store is hosted by Shopify, your information is also processed by Shopify and our service providers, some of whom are located outside your country.
• Governing law: These terms are governed by the laws of Queensland, Australia. If you're a consumer living overseas, you can still rely on the mandatory protections of your local law and bring a claim in your local courts.
• Changes: We may update these terms from time to time. The version on our website when you place an order applies to that order, and we'll tell you about significant changes where the law requires.
• Severability: If any part of these terms is found to be unenforceable, the rest still applies.

• Assignment: You can't transfer your rights under these terms without our consent. We may transfer ours to a business that takes over Harmony Modern, as long as your rights aren't reduced.
• Entire agreement: These terms, together with the policies they refer to, are the whole agreement between you and us about your use of our website and purchases.
• Waiver: If we don't enforce a term straight away, we can still enforce it later.
• Headings: Headings are for convenience only and don't affect how these terms are read.
